Weed is legal in Oklahoma for medical use only. Every legal purchase runs through a state patient licence, held by the patient or by the caregiver or guardian buying for them.

Oklahoma has no adult-use market. The Oklahoma Medical Marijuana Authority (OMMA) licenses patients, caregivers and dispensaries. Patients must present their licence at every purchase. Oklahoma is medical only, not legal for adult use, as of October 26, 2026.

Who can buy marijuana in Oklahoma?

Four kinds of people turn up at an Oklahoma dispensary counter, and only the one with no licence is turned away.

Short-term (60 day) and two-year licences are for Oklahoma residents only. OMMA says a visitor cannot get either one.

Can you go to a dispensary without a card in Oklahoma?

No. Oklahoma dispensaries sell only to licensed patients and their caregivers or guardians.

OMMA’s FAQ says a patient must present the licence identification card every time they purchase. The statute adds that medical marijuana must be purchased solely from a state-licensed medical marijuana business (63 O.S. 427.13). Minors with an out-of-state licence cannot enter a dispensary without a parent or legal guardian.

What is the out-of-state temporary licence?

The temporary licence is a 30-day Oklahoma patient licence for visitors who already hold a medical marijuana licence from another state.

  • Eligibility. The statute grants it to holders from states with a state-regulated medical program. OMMA says the licence must be one issued by another state’s government. Missouri and Arkansas patients qualify. Texas patients do not, and prescriptions or licences from out-of-state providers are not honored.
  • Documents. The rule (OAC 442:10-2-4) asks for a colour copy of your unexpired out-of-state licence, an unexpired photo ID, and a digital photo. Applicants under 18 also meet the minor requirements.
  • Fee. The statute sets $100 and lets a reprint cost $20. OMMA’s page lists $100 plus a $4.30 processing fee, $104.30 in total. Application fees are nonrefundable.
  • Length. The rule says the licence lasts 30 days from issue and cannot run past the expiry of your home-state licence (OAC 442:10-2-5(d)).
  • Renewal. OMMA’s FAQ says you can apply for a new licence starting one week before the current one expires. The statute says renewal means a fresh application.

What does a longer visit cost?

A 45-day visit needs two temporary licences, which costs $208.60 in fees.

The arithmetic: 45 days divided by 30 days is 1.5, so you need two licences. Two times $104.30 is $208.60. The second application can open about a week before the first ends. A visit of 30 days or less costs $104.30. Each licence also stops at your home licence’s expiry, so a card that expires mid-trip shortens the Oklahoma licence.

How much marijuana can you have in Oklahoma?

A licensed Oklahoma patient may carry up to 3 ounces of flower and keep up to 8 ounces of flower at home.

OMMA’s rules say these limits are cumulative, so a patient may hold all of them at once (OAC 442:10-2-8). A single dispensary transaction is capped at 3 oz of flower, 1 oz of concentrate and 72 oz of edibles (OAC 442:10-5-12). Rule numbers are from the August 2023 OMMA rule document.

What if you have no licence and get stopped?

Possession of up to 1.5 ounces without a licence, by a person who can state a medical condition, is a misdemeanor with a fine up to $400.

The statute says there is no imprisonment for that offense, and the officer issues a written citation. Section 420(B) covers only that case; carrying more than 1.5 ounces puts you outside it, so see a lawyer.

Where can you smoke weed legally in Oklahoma?

Only licensed patients may consume marijuana in Oklahoma, and smoking is limited to where tobacco is allowed.

OMMA’s rule says smoked and vaped products are subject to the same restrictions as tobacco under the Smoking in Public Places and Indoor Workplaces Act (OAC 442:10-2-11). Minors may not smoke or vape unless both recommending physicians agree it is medically necessary.

Can you use it in a car?

No. Since November 1, 2025, it is unlawful to consume marijuana, or inhale another person’s marijuana smoke, while operating a vehicle on a public road.

Senate Bill 786 also bars a driver from having an open container of marijuana in the passenger area. A violation is a misdemeanor, and a conviction adds a $250 trauma-care fee. The bill makes no exception for licensed patients. Driving while impaired is a separate offense; the Oklahoma Highway Safety Office says medical use does not make impaired driving safe.

Can a landlord ban it?

A landlord cannot refuse to lease to a person only because they are a licensed patient, but the statute does not say a landlord must allow smoking.

Section 425 says no school or landlord may refuse to enroll or lease to, or otherwise penalize, a person solely for patient status, unless it would cost them a federal benefit. The text says nothing about smoking on the property. Read your lease.

THCA products are legal as hemp in Oklahoma only if they test at or below 0.3% total THC, and the federal rules that change this take effect in late 2026.

The Oklahoma Department of Agriculture said on January 16, 2026 that hemp products may test no more than 0.3% total THC, where total THC is THC plus 87.7 percent of THCA. Flower high in THCA fails that test. The same letter says the federal change to the hemp definition applies from November 12, 2026. That date has since moved for part of the change: Public Law 119-103 delays the total-THC definition and the 0.4 mg per container cap to December 11, 2026. Our hemp ban timeline lays out both dates, and THCA versus THC explains the chemistry.

Delta-8 made under Oklahoma’s hemp program stays outside the medical marijuana definition, and the federal change is set to remove it from the hemp definition.

The Department of Agriculture’s letter says cannabinoids made outside the plant, with delta-8 given as the example, will no longer count as hemp under the federal change. Whether that applies on November 12 or December 11, 2026 depends on the kind of cannabinoid; the hemp ban timeline has both dates. On the state side, Oklahoma’s Medical Marijuana and Patient Protection Act excludes plant or material containing delta-8 or delta-10 from its marijuana definition when it is grown, processed or sold under the Oklahoma Industrial Hemp Program (63 O.S. 427.2(26)). That exclusion is conditional, so it does not clear every delta-8 product, and dispensaries do not sell hemp.

Will Oklahoma legalize weed in 2026?

No adult-use law is in force in Oklahoma as of October 26, 2026. The medical-only system stands.

Medical marijuana has been legal since State Question 788. OMMA still runs the patient, caregiver and business licences. For flower sold as hemp, see is THCA legal. For federal context, see what rescheduling did and did not change. Crossing state lines with product is a separate problem, covered in bringing weed on a plane.
