Hemp, THCA and delta-8
These guides track the federal hemp change and the state rules on THCA, delta-8 and other hemp products. Every date and limit links to the law or agency notice it comes from.
- Will the Hemp Ban Affect Dispensaries in Legal States?
The federal hemp ban changes the definition of hemp, not the status of state-licensed marijuana, so dispensaries in legal states keep selling marijuana. Hemp-derived products on their shelves are affected: above 0.4 mg total THC per container they leave the hemp definition on 11 December 2026 (P.L. 119-103). Check your state regulator.
- When Will the Hemp Ban Take Effect? Two Dates: Nov 12 and Dec 11, 2026
The federal hemp ban takes effect in two steps. On 12 November 2026, hemp products with cannabinoids the cannabis plant cannot make naturally leave the hemp definition. On 11 December 2026, the rest follows, including the cap of 0.4 mg total THC per container (P.L. 119-103, section 2019). State law can differ.
