## Is weed legal in Ohio?

Weed is legal for adults 21 and older in Ohio, with limits on amount, source and place. Voters passed Issue 2 on November 7, 2023, with 57% support, and possession and home grow took effect on December 7, 2023, according to the [Moritz College of Law](https://moritzlaw.osu.edu/research/adult-use-marijuana-ohio-what-you-need-know).

Ohio uses the status "legal (adult use)". It also has a separate medical program. Federal law still lists marijuana as a controlled substance, so the state rules stop at the state line. Neighbors differ: [Indiana](https://isweedlegal.com/is-weed-legal-in-indiana/) and Kentucky have no adult-use market.

## How much weed can you have and buy in Ohio?

An Ohio adult may possess 2.5 ounces of marijuana in any form except extract, plus 15 grams of extract, per the Moritz College of Law. Lawfully grown seeds, live plants and clones do not count toward the plant-material weight.

Buying has its own caps. Since June 4, 2025, dispensaries follow the statutory daily transaction limit: 2.5 ounces of plant material, plus other products up to 15,000 mg of total THC, per the [Division of Cannabis Control](https://dam.assets.ohio.gov/image/upload/com.ohio.gov/DCC/Non-Medical_Sales_Limits.pdf). Only dried flower for vaporization counts toward the 2.5 ounces; every other product counts toward the 15,000 mg.

Here is each limit in one place, as of 2026-10-27. The "since" column is the date the rule began.

|---|---|---|---|

Senate Bill 56 passed the General Assembly on December 9, 2025. Governor DeWine signed it on December 19, 2025, and it took effect on March 20, 2026, per the Moritz College of Law. It kept the amounts but tied them to Ohio-sourced cannabis.

## How many weed plants can you grow in Ohio?

An Ohio adult 21 or older may grow six plants, and a residence may hold no more than twelve. One plant over the cap can bring a cultivation charge, per [Signal Cleveland](https://signalcleveland.org/ohio-senate-bill-56-new-law-marijuana-intoxicating-hemp-dispensary-sales-criminal-penalties-2026/). Other states set different caps; see how many plants you can grow state by state.

- Home grow must be at your primary residence. Renters must follow their lease.
- Homegrown marijuana cannot be held for another person, given away for pay, or passed on at a place that is not a private residence or agricultural space.
- Home grow is barred at childcare centers, halfway houses and community residential centers.

A worked example shows how the household cap works:

- Two adults live together: 2 x 6 = 12 plants. They are at the cap.
- Three adults live together: 3 x 6 = 18 on paper, but the residence cap is 12. Planting a 13th is over the limit.
- One adult living alone: the cap is 6, not 12.

A second example covers a day of buying. The 2.5 ounce plant-material limit is about 71 grams (2.5 x 28.35). A buyer who takes 2.5 ounces of flower has used the plant-material allowance for the day, and more flower the same day exceeds the cap. Vapes, edibles and extracts draw on the separate 15,000 mg THC allowance, so a 1,000 mg THC vape cartridge leaves 14,000 mg for the day. At home, the possession limit still applies: 2.5 ounces of non-extract product and 15 grams of extract.

## Can you smoke weed in public in Ohio?

No. Since March 20, 2026, smoking or vaping marijuana is allowed only at private residences and some agricultural land, and public use is a minor misdemeanor.

The Moritz College of Law lists these related rules:

- Smoking or vaping is banned in bars, restaurants, sports venues and other public indoor spaces.
- It is banned in a private home that also runs as a childcare center.
- Rental housing can ban it in the lease.
- A passenger who smokes or vapes in a vehicle being operated, or under the operator's physical control, can face a third-degree misdemeanor.

Employers can still enforce drug policies. Signal Cleveland also reports that a worker fired for breaking such a policy is not eligible for state unemployment benefits under SB 56. Gun owners: medical card holders and firearms is a federal question, not an Ohio one.

## Can you bring weed into Ohio or share it?

You cannot bring weed into Ohio from another state, even if you bought it legally there. Signal Cleveland reports that shipping it into Ohio is also banned.

Sharing is allowed at a private residence or agricultural space, up to the possession limit. Taking money for it is not allowed. For flying and driving across state lines, see our guide on [bringing weed on a plane](https://isweedlegal.com/can-you-bring-weed-on-a-plane/).

## What is the Ohio hemp ban?

Since March 20, 2026, intoxicating hemp products, including delta-8 and hemp-derived THC drinks and gummies, cannot legally be sold anywhere in Ohio, including licensed marijuana dispensaries. The Division of Cannabis Control says these products are "not simply moving into dispensaries," per the [Moritz College of Law](https://moritzlaw.osu.edu/research/adult-use-marijuana-ohio-what-you-need-know). Dispensaries sell products from Ohio's licensed marijuana supply chain.

A Franklin County judge denied a last-minute request to block the law on March 19, 2026, per [ABC6](https://abc6onyourside.com/news/local/franklin-county-judge-declines-to-halt-ohio-intoxicating-hemp-ban-thc). That was an interim ruling, not a final judgment.

Potency: SB 56 set a 70% THC cap for extracts, down from 90%, and Signal Cleveland reports 35% for plant material. Moritz now lists all marijuana products at a 90% THC cap, and the packaging rule effective October 5, 2026 (OAC 1301:18-4-06) sets package-level THC limits for retail sale. Adult-use edibles are limited to 10 mg THC per serving and 100 mg per package.

| Layer | Date | What it covers |
|---|---|---|
| Ohio SB 56 | March 20, 2026 | Intoxicating hemp banned from retail, dispensaries included |

| Federal hemp change, part two | December 11, 2026 | Total-THC definition and 0.4 mg per container exclusion |

The federal dates come from Public Law 119-103. For how the federal change reaches states with legal weed, read [will the hemp ban affect legal states](https://isweedlegal.com/will-the-hemp-ban-affect-legal-states/). For the chemistry, see [THCA vs THC](https://isweedlegal.com/thca-vs-thc/).
